Accordingly, Conversational LLC. does not take any responsibility for the truth and accuracy of the information, and the use that is made of it, which is entirely at the Subscriber’s own risk, and without recourse to Conversational LLC. All rights reserved. - Use of Information
Information collected by Conversational LLC. from the Subscriber may be used by Conversational LLC. in accordance with Conversational LLC. Privacy Policy https://www.conversational.com/privacy-policy/ and as may be amended from time to time. The Subscriber agrees to regularly review Conversational’s Privacy Policy. - Condition of Use
In accepting a subscription to the products and services with Conversational LLC., or through any Channel Partner with whom Conversational LLC. may be acting as a Service Provider, the Subscriber AGREES to the following Terms and Conditions of use:
Subscriber acknowledges and accepts clauses (1) and (2) above;
On completion of a Subscription form, a unique telephone number shall be allocated to the Subscriber to retain the number as long as they like. The Subscriber however must remain up to date with their Subscription. To include all payments due attached to the Subscriber’s account with Conversational LLC. If for whatever reason the Subscriber goes into a delinquent status, Conversational LLC. reserves the right to cancel all services attached to Subscriber; to include relinquishing the phone number given. In the event that the service is cancelled, the telephone number allocated to Subscriber shall be relinquished, for use as Conversational LLC. sees fit.
Upon cancellation of the service, Conversational LLC. shall not take any responsibility whatsoever for receipt and delivery of any messages sent to Subscriber’s message center subsequent to that cancellation; this is also true for all calls still directed towards Conversational LLC. systems.
Conversational LLC. shall be entitled at any time to withdraw services with the Subscriber, and Subscriber’s telephone number, without notice, or for whatever reason;
Subscriber shall not transmit or cause to transmit any material that is derogatory, racist, abusive, threatening, obscene, hateful or in any other way objectionable to others and or illegal;
Subscriber shall not use any services provided by Conversational LLC. to ‘spam’ or cause mischief to others;
If Subscriber ‘spams’, or causes any nuisance using any of the services, Conversational LLC. shall, at its sole discretion, and without prior notice withdraw services to Subscriber;
In the event there is any cause whatsoever to believe that the service provided by Conversational LLC. is being used to contravene any law, that service or product shall be immediately cancelled. Any such cancellation shall be at the sole discretion of Conversational LLC., and shall be done without notice to the Subscriber or recourse to Conversational LLC.
30 Day Money Back Guarantee are not applicable for prior Conversational LLC. clients, casual clients or new clients that require Conversational LLC. services for promotional and advertising campaigns. 30 Day Money Back Guarantee coverage starts at time of Subscription and must be cancelled as directed in the cancellation procedures below, before the Subscriptions end date in order to avoid Subscription’s first invoice fees equal to that of the selected plan’s rate and overage fees applicable.
Conversational does not take any responsibility for inbound calls made by telemarketers, misdialed numbers, promotional companies or callers not wanting to leave a message. These types of calls are chargeable as per the nominated subscription and are referred to as inbound calls. - Virtual Reception Plans and Additional Fees
Conversational provides three levels of service based on volume/minutes of calls answered by a Conversational LLC. receptionist. Each plan is charged at the scheduled rates.

Premier Services
Conversational LLC. provides additional call handling and scheduling services to clients which are agreed upon at time of implementing those services. This fee is billed in addition to the plan rate for reception services monthly. Premier Service features are charged at the rate of $79/month
Receptionist Minutes
Conversational bills using the concept of what we call “Receptionist minutes”. You are being billed for the entire length of every call. This is referred to as “time sensitive” billing or “true time” billing. You are billed for the exact time Conversational receptionists are on the line taking action on the call. If you have a call that lasts only 15 seconds, you are billed for just 15 seconds. Minutes our receptionists are on the line with your caller or connecting the call to your business are all that are considered billable minutes. Hold time is included. For inbound calls, Receptionist Minutes are calculated starting from the time the Receptionist receives the call and ending when a Receptionist transfers the call through to someone, or to voicemail, or otherwise disconnects because the call has ended. For Outbound calls, minutes are calculated by counting the time our Outbound Receptionist is on the call. Starting from the time the Receptionist starts the call and ending when the call has ended.
Overage Minutes
Conversational LLC. charges Subscriber a rate of $2.10 per minute on any inbound/outbound minutes they go over on Subscriber’s allotted plan minutes. Overage charges are billed to the Subscriber on the 1st business day of each month without warning. Our 30 Day Money Back Guarantee caps at 1000 minutes and all used minutes above this value will be charged at the rate of $2.10/minute at the time of cancellation or renewal.
Additional Numbers
Should the Subscriber require any additional numbers for the account those are charged at a rate of $10/month on current plans invoice date.
Toll-Free Numbers
Should the Subscriber require a Toll-Free number for the account those are charged at a rate of $25/month, up until 500 minutes. Toll Free minute usage above 500 minutes per month will be charged as overage minutes.
Late Fees
Any payment(s) not received within 5 days after the Due Date, and every month thereafter, are subject to a Monthly Late Charge equal to $15. Conversational reserves the right to change prices at any time.
- Credit Card Payments
When subscribing, Subscriber’s are required to enter their full name, e-mail address, mailing address, credit card number, CVV code, and card expiration date. This enables Conversational LLC. to process the Subscriber’s order and to notify them regarding its status. By its nature, Conversational LLC. cannot guarantee that information transmitted on the internet is 100% secure. To reduce this risk, we use a secure server for online credit card transactions with up to date encryption methods. Information on this secure server is not available to Conversational LLC. general staff. However, these transactions are undertaken at your risk, as Conversational LLC. cannot ensure the security of any information transmitted. - Cancelling Service
The Subscriber may cancel a service by notifying Conversational LLC. at any time prior to the monthly renewal date and/or end of the 30 Day Money Back Guarantee. The service will continue until the current prepaid monthly subscription expires or immediately, depending on the cancellation request option chosen by the subscriber. Conversational LLC. does not provide a refund for early cancellation of any service. All 30 Day Money Back Guarantee plans must also be cancelled in this same method or will be subject to the first invoice charges for usage rendered. Overage rates for services rendered are also applicable at time of cancellation. - Rights to Suspend or Terminate Overdue Accounts
If any amount owing by the Subscriber under this or any other agreement for our service is 5 or more days overdue; we reserve the right to either suspend or terminate access to the services with or without notice, until such obligations become immediately payable in full. If the account requires a full termination without a proper cancellation request (per our terms of agreement) the Subscriber will still remain responsible for all subscription fees owed as well as any and all applicable sales and use taxes for the purchase of the subscription based on the address that was provided when registering as a subscriber with Conversational, LLC. All fees are quoted in United States dollars. If at any time you wish to reinstate services after the subscription was terminated by Conversational due to non-payment, a one-time $25 reactivation fee will be applied for the creation and re-activation of the terminated account. For services to be re-instated, the $25 reactivation fee must be paid in full prior to activation. This fee will be charged to the credit card on file. - Security
- The Subscriber agrees and acknowledges that Conversational LLC. shall not be liable to the Subscriber or any other person for any of the following:
- Performance, security, reliability, and Subscriber’s competence in the use of the internet, telecommunications companies, and internet service providers in transmitting information;
- Confidentiality of Subscriber password;
- Use of the Conversational Messaging by third parties, for any reason. Subscriber is responsible for password security, and must ensure that this password is not disclosed to any third party, for whatever reason;
- Security of any information transmitted on the internet.
- Exclusion of Liability
Subscriber agrees and acknowledges that Conversational LLC. shall not be liable for any claims of whatsoever kind or nature (including claims for negligence) that might arise directly or indirectly out of any act or omission, use or misuse of any of the services by the Subscriber or for anything else done or not done by Conversational LLC. To the extent this clause fails to fully and completely exclude any claim and/or to the extent any third party might make any claim against Conversational LLC. in any way related to the Subscriber’s use or misuse of the services or anything done or not done for the Subscriber by Conversational LLC. then the Subscriber hereby indemnifies Conversational LLC. against any and all liabilities losses expenses and costs that might be suffered or incurred by Conversational LLC. as a direct or indirect consequence of any such claims being made. - Conversational LLC. hereby excludes all and any liabilities, costs, damages, losses or expenses of whatsoever kind or nature which may be claimed by Subscriber or any third party against Conversational LLC. including claims for negligence in relation to any matter whatsoever arising from this Agreement. Conversational LLC. hereby agrees to provide various Telecommunications Services to Client pursuant to the Terms and Conditions set forth herein and in the Service Agreement.
Term
This agreement shall be ongoing and shall automatically renew unless Cancelation has been made prior to the clients next billing period.
First 30 days
During the first 30 days of service, services are covered by a 30 Day Money Back Guarantee (up to 1000 minutes) for the prepaid minutes for the promotional plan purchased. (Conversational LLC. charges $2.10 per minute on any minutes over the prepaid plan’s minute values or usage over 1000 minutes). ) Services are cancelable by either party at any time during this 30 Day Money Back Guarantee period.
Payment
Regular service shall initiate on the date set forth in the Service Agreement. On or before the first of the month immediately following Initiation Date, and on or before the first of every month thereafter, Client shall pay to Conversational LLC. the Monthly Charge. In addition to the Monthly Charge, Variable Charges may be assessed pursuant to the Service Agreement. All charges are shown in United States dollars. All payments must be received by Conversational LLC. no later than 5 days after Due Date. The Due Date for the Monthly Charge is the Monthly reoccurring date for when the account was created. The Due Date for the Variable Charges is the first of the month immediately following the month for which service is provided. Client shall, at all times, maintain a valid Credit Card(s) on file with Conversational LLC. Client hereby authorizes Conversational LLC. to debit Client’s Credit Card(s) to satisfy any and all amounts due to Conversational LLC. In the event Conversational LLC. does not receive full payment within 5 days of Due Date, Client is then considered to be in Material Default of this Agreement and Conversational LLC. shall have the right to immediately terminate service without waiving the right to collect any and all amounts then due plus all Late Fees that may accrue thereafter.
Late charge
Any payment(s) not received within 5 days of the Due Date, and every month thereafter, are subject to a Monthly Late Charge equal to $15.
Confidentiality
Conversational LLC. will use reasonable care to maintain the confidentiality of Client confidential information provided to Conversational LLC. in the course of providing the Telecommunication Services. Conversational LLC. will not disclose or use such confidential information, except as authorized by Client or otherwise compelled by law. Client’s confidential information shall not include any information in the public domain through no fault of Conversational LLC., or information received from a third party having the right to transfer such information.
Liability
Conversational LLC. makes no representations or warranties, expressed or implied, of any kind to Client or third party regarding Conversational LLC. services. Conversational LLC. shall use reasonable efforts to provide the agreed upon services however, in no event, shall Conversational LLC. be liable to Client, or any third party, for any claims for loss or damages as a result of any action or inaction by Conversational LLC.
Miscellaneous
Conversational LLC reserves the right to terminate or otherwise suspend Subscriber’s account if the Subscriber or their callers are abusive, disrespectful, or otherwise inappropriate to Conversational LLC receptionists or service providers.
Conversational LLC reserves the right to not respond to requests, or terminate Subscriber’s account, if:
Conversational LLC suspects that a request constitutes or otherwise relates to fraudulent or otherwise illegal activity;
Conversational LLC suspects that the request relates to a sexual or otherwise potentially illicit encounter; or
The Subscriber harass, or otherwise make inappropriate comments or suggestions to Conversational LLC staff or personnel.
The laws and jurisdiction of the state of Virginia shall govern any and all matters of dispute between Conversational LLC. and the Client. Any dispute arising from these Terms and Conditions shall be resolved in the state or federal courts located in Stafford County, Virginia, and the parties irrevocably consent to jurisdiction in such courts.
Jurisdiction
The laws and jurisdiction of the state of Virginia shall govern any and all matters of dispute between Conversational LLC. and the Client. Any dispute arising from these Terms and Conditions shall be resolved in the state or federal courts located in Stafford County, Virginia, and the parties irrevocably consent to jurisdiction in such courts.
